Terms & Conditions
A stay for a period of every year for up to 6 Nights and 7 Days at TREE HOUSE LUXURY VACATIOS PVT. LTD. properties each year within India for the stipulated number of years from the date of this Agreement.
The 6 Nights & 7 Days holidays can also be taken in any of the tied-up properties worldwide.
The accommodation shall be provided in regular and superior rooms for Studio Members, and two such rooms will be given to members who have bought One Bedroom Membership.
All short-term accommodation stays include Studio rooms only for the selected time for the Second Party, spouse, and two children below 6 years of age. An extra bed will be charged at the rate of Rs. 1000/- in TREE HOUSE LUXURY VACATIONS PVT. LTD. owned properties and as applicable in associated properties. Dependent vacationers above 18 years are considered adults. A maximum of 3 adults can be accommodated in one Studio room. An extra room must be taken at an additional cost if there are more than 3 adults. A 1BR unit accommodates 4 adults and two children under 6 years.
Short Term Accommodation Vacation
Floating Week Opted.
The vacationer is required to make payment towards the Annual Maintenance Charges (AMC) of Rs. 11,798/- (Rupees Eleven Thousand Seven Hundred Ninety-Eight only) for Studio units and Rs. 19,470/- (Rupees Nineteen Thousand Four Hundred Seventy only) for 1BR units towards vacations in the First Party's owned or affiliated/associated properties.
The AMC is applicable from the date of this Agreement and may be revised without prior notice. The Annual Maintenance Charges are payable online, excluding taxes, and are payable irrespective of usage of the vacations, facilities, or amenities.
Failure to clear dues, including AMC payable to the First Party, shall constitute a default, and vacations cannot be utilized until all dues are cleared. The vacationer acknowledges that there is no offer of any kind allowing waiver of AMC. An exchange fee may also apply if the property is in a domestic or international associated location.
AMC will be generated nine (9) months from the date of this Agreement and is payable within twelve (12) months from the date of this Agreement, irrespective of whether the Second Party has made full or partial payment towards the product price.
In the event the Second Party chooses the "Cash Out" price, the entire amount must be paid within 30 days of the initial payment. If payment is not completed within 30 days, the First Party shall revoke the Cash Out benefits and collect the full product price from the Second Party.
This is a limited and exclusive offer. If the full amount is not remitted within 45 days from the date of the initial payment, all amounts remitted until then shall be forfeited by TREE HOUSE LUXURY VACATIOS PVT. LTD., and any vacations allotted shall be canceled.
If the Second Party continues to default in completing payments towards the Cash Out price even after one year, the First Party reserves the right to downgrade the benefits of the product to the closest-priced product to complete the transaction. Once downgraded, the benefits under this Agreement shall no longer be available. Any benefits already availed under this Agreement before degradation shall be adjusted against the downgraded product.
Particulars of the Vacations
TREE HOUSE LUXURY VACATIOS PVT. LTD. reserves the right to withdraw any property from its list at any time without prior notice. Holiday booking is available online/offline on a first-come, first-served basis. Online bookings are subject to room availability.
The membership card shall be issued subject to submission of ID proof, address proof, photographs, and compliance with KYC norms for the entire family.
Holiday booking is to be done online using the username and password mentioned on the online receipt, which will also be sent along with the welcome letter and booking instructions. The Second Party may utilize vacations immediately upon full payment of the product price and all other dues, even before receiving the membership card and welcome kit.
During peak periods, if occupancy is high, shorter holiday durations may be allotted after giving priority to higher-season members.
A continuous vacation of 6 Nights and 7 Days may be split into any one of the following combinations per year:
- 2 Nights / 3 Days
- 3 Nights / 4 Days
- 4 Nights / 5 Days and 2 Nights / 3 Days
Exit Option
This Agreement may be canceled by either party within seven (7) days from the date of signing by providing written notice (without assigning any personal reason). If no such notice is received within the stipulated period, the parties agree to remain bound by the Agreement, and the Developer shall not refund any money held by it.
Refund
If the Agreement is canceled under the Exit Option, the Company shall refund the amount received after deducting an administration fee of Rs. 25,000/- paid by the purchaser, without interest, within 90 days from the date of the cancellation request.
The refund amount shall be paid after 30 days from the date of receipt of the cancellation request letter.
All holidays are subject to availability under the floating week system. Booking priority is provided to higher-category members before lower-category members.
Renting of vacations is permitted only during the off-peak season through personal contacts and may not be advertised. TREE HOUSE LUXURY VACATIOS PVT. LTD. does not engage in renting vacations and reserves the right to reject any booking.
Vacation vouchers shall be issued only after submission and successful verification of all required documents. There are no separate holiday vouchers for sale, and the Second Party is entitled only to the benefits specified in this Agreement.
The Second Party shall pay all applicable taxes and government levies.
Charges for food, beverages, and other facilities shall be determined by the management from time to time and must be settled daily. No credit facility shall be provided.
The Second Party may be denied vacation benefits if any amount remains outstanding under any other agreement with the First Party.
Covenant of Purchaser
The Second Party agrees to purchase vacations from TREE HOUSE LUXURY VACATIOS PVT. LTD. subject to the terms and conditions of this Agreement.
The Second Party confirms understanding of all benefits available under the vacation scheme and acknowledges that no benefits other than those mentioned in this Agreement shall be available.
The Second Party agrees to notify the Customer Care Department of any change in address, telephone number, or other contact information. The Second Party authorizes TREE HOUSE LUXURY VACATIOS PVT. LTD. to contact them via phone, SMS, or email, even if registered under DND, regarding services and future offers.
The Second Party agrees to abide by the Rules and Regulations of TREE HOUSE LUXURY VACATIOS PVT. LTD., as amended from time to time. The decision of the management shall be final in all matters.
In addition to these Terms and Conditions, all applicable laws shall be binding upon the Second Party. Any legislative changes resulting in additional obligations or changes to the Company's activities shall automatically apply to this Agreement to the extent required by law.
This printed Agreement supersedes all prior written or oral communications, handwritten remarks, representations made by agents or representatives, company letterheads, or stamp papers. Only the terms contained in this Agreement shall be binding upon both parties.
The Second Party confirms that no verbal or written promises or assurances contrary to this Agreement have been made by any representative of TREE HOUSE LUXURY VACATIOS PVT. LTD.
The Second Party declares that all information provided is true, correct, and complete. The Company shall not be liable for any delay or failure caused by incorrect or incomplete information.
The Second Party shall notify the Company within 30 days of any change of residential address and provide valid address proof. If no such notification is given, all communications sent to the address mentioned in this Agreement shall be deemed validly served.
The Second Party acknowledges and agrees that all Terms and Conditions of TREE HOUSE LUXURY VACATIOS PVT. LTD., including future amendments, shall be binding.
The Second Party confirms that they have been treated courteously and have entered into this Agreement voluntarily without coercion, undue influence, or compulsion.
The Second Party confirms having read, understood, and accepted all Terms and Conditions, benefits, and obligations contained in this Agreement.
